Please read these Terms and Conditions carefully before using the Listing.WTF website or purchasing any of our services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. About Listing.WTF
Listing.WTF ("we", "us", "our") is an AI automation service provider that builds and manages intelligent lead response systems for real estate agents and brokerages. Our services include automated SMS and email follow-up agents, CRM integrations, listing description generation, and related AI-powered workflow tools. We operate as a technology service provider to real estate professionals, not as a licensed real estate brokerage.
2. Services
We offer the following service packages, as described on our website:
- Starter Plan — AI lead response agent, appointment booking automation, review request sequence, and monthly reporting.
- Growth Plan — All Starter features plus past client nurture agent, open house follow-up agent, listing description generator, CRM hygiene automation, and bi-weekly strategy calls.
- Brokerage Plan — All Growth features deployed for up to 8 agents, plus lead routing, transaction coordination, team dashboard, onboarding automation, and dedicated support.
Service details, deliverables, and pricing are as described on our website at the time of purchase. We reserve the right to update our service offerings with reasonable notice to existing clients.
3. Payment and Fees
- All services require a one-time setup fee payable at the start of the engagement, plus a recurring monthly retainer.
- Payments are processed securely through PayPal. By purchasing our services, you agree to PayPal's Terms of Service.
- The setup fee is non-refundable once work has commenced. Monthly retainers are billed in advance and are non-refundable for the current billing period.
- We reserve the right to suspend services if payment is not received within 7 days of the due date.
- All prices are listed in US Dollars. You are responsible for any applicable taxes in your jurisdiction.
4. Cancellation Policy
- You may cancel your monthly retainer at any time after the first 90 days of service by providing 30 days written notice to contact@listing.wtf.
- During the initial 90-day period, cancellations are not permitted as this time is required to build, test, and optimize your agent systems.
- Upon cancellation, we will provide a full offboarding package including documentation of all agent workflows, data export, and transition support.
- We reserve the right to terminate services immediately if you violate these Terms, engage in fraudulent activity, or use our services for unlawful purposes.
5. Client Responsibilities
To deliver our services effectively, you agree to:
- Provide accurate and complete information about your business, CRM, lead sources, and integrations in a timely manner.
- Grant us necessary access to your CRM, email platform, lead sources, and any other systems required to build and operate the agent workflows.
- Ensure that all contacts in your CRM and lead sources have consented to receive automated communications as required by applicable law, including TCPA and CAN-SPAM.
- Review agent outputs regularly and notify us of any issues, errors, or changes to your business requirements.
- Maintain active accounts and valid credentials with all third-party platforms required for your service package (e.g. Twilio, Follow Up Boss, Gmail).
- Not use our services to send spam, harass individuals, violate any laws, or engage in any activity that could damage our reputation or infrastructure.
6. AI-Generated Content
Our services use large language models (LLMs) to generate personalized SMS messages, emails, and listing descriptions on your behalf. You acknowledge and agree that:
- AI-generated content may occasionally contain errors, inaccuracies, or outputs that require human review and editing.
- You are solely responsible for reviewing AI-generated content before it is used in any regulated context, including but not limited to real estate disclosures, contract language, or financial representations.
- We do not guarantee that AI-generated listing descriptions, market analyses, or property valuations are accurate or complete.
- You retain ownership of all content generated by our AI systems on your behalf. We may use aggregated, anonymized data from agent outputs to improve our services.
7. SMS and Email Compliance
- You are responsible for ensuring that all contacts who receive SMS or email communications through our system have provided the required consent under applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
- You must maintain records of opt-in consent for all contacts in your system.
- You must honor all opt-out requests immediately. Our systems are configured to process STOP requests automatically, but you are responsible for ensuring no further contact is made.
- We are not liable for any TCPA violations, regulatory fines, or legal claims arising from your failure to obtain proper consent from your contacts.
8. Intellectual Property
- All software, workflows, automation frameworks, prompt templates, and proprietary methodologies developed by Listing.WTF remain our exclusive intellectual property.
- Content generated by our AI systems specifically for your business (SMS copy, emails, listing descriptions) is owned by you upon delivery.
- You may not reverse engineer, resell, sublicense, or reproduce our proprietary systems, workflows, or templates without our express written consent.
- The Listing.WTF name, logo, and brand assets are our trademarks and may not be used without permission.
9. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement, including but not limited to business strategies, client data, API credentials, pricing, and technical workflows. This obligation survives termination of the service agreement for a period of two years.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- Listing.WTF's total liability to you for any claims arising out of or related to our services shall not exceed the total fees paid by you in the three months preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost deals, or business interruption, even if advised of the possibility of such damages.
- We are not liable for failures, outages, or errors caused by third-party services including Twilio, Make.com, Follow Up Boss, Anthropic, PayPal, or Shopify.
- We do not guarantee specific business outcomes, including lead conversion rates, additional closed deals, or revenue increases.
11. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Listing.WTF and its officers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these Terms, your violation of any applicable law, or any content you provide to us or distribute through our systems.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
14. Dispute Resolution
Before initiating any legal action, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days. If the dispute is not resolved within 30 days, either party may pursue their legal remedies as provided under these Terms.
15. Changes to These Terms
We reserve the right to update these Terms at any time. We will provide at least 14 days notice of material changes via email or a notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
